How Hightower sells: resale and referrals

Depending on the product, Hightower either resells it to you through Hightower Checkout or refers you to the independent seller's own website to buy it there.

• Resale: Roasted coffee is currently the only product Hightower resells through Hightower Checkout. For those purchases, Hightower Coffee LLC is the seller you buy from.
• Referral: All other products, including green coffee and anything sold on a roaster's or supplier's own site, are referrals. You buy directly from that business under its own terms, prices, shipping and refund policies, and Hightower may earn a referral commission.

1.1 Agreement

Welcome to Hightower. By accessing or using our website, marketplace, account features, purchasing services, or business tools, you agree to these Terms of Service and the applicable policies incorporated into them.

If you do not agree, you must not use services that require acceptance of these Terms.

Additional terms apply to Hightower Checkout, business accounts, supplier sourcing, paid services, and other features described in their respective agreements.

1.2 Our services

Hightower provides coffee discovery, product listings, personalized coffee recommendations, account and profile tools, retail purchasing for eligible products, and business sourcing and marketplace services.

Not all listed coffee products are available for direct purchase through Hightower.

Products marked as eligible for Hightower Checkout are sold through Hightower's checkout by the seller identified in the transaction, which is intended to be Hightower's operating entity for its own retail sales.

Other products may direct customers to independent merchants. Purchases made on those merchants' websites are governed by their own sales terms, payment procedures, shipping conditions, and refund policies.

Business sourcing transactions may involve separate arrangements negotiated between buyers and suppliers.

1.3 Eligibility and accounts

Users must provide accurate registration information, safeguard account credentials, and keep account information current.

Customers must be at least 18 years old to purchase products or enter into commercial agreements through Hightower. Users under 18 may access eligible non-transactional features only if permitted by the applicable service and law.

Accounts are intended for individual or authorized business use. You may not impersonate another person, register a fraudulent business, or misuse another user's account.

Hightower may request reasonable verification of identity, business status, or transaction authorization.

1.4 Product information

Hightower displays information concerning coffee origin, roaster, producer, processing, flavor, roast, price, availability, and other characteristics.

Information may be provided by independent businesses, obtained from permitted sources, or generated through Hightower's catalog processing systems.

We endeavor to maintain accurate information but do not guarantee that every third-party statement is complete or current.

Material product representations made by Hightower remain subject to applicable consumer-protection laws.

1.5 Personalized tools

Coffee Profile, Find Your Coffee, Coffee Passport, and other personalization features provide recommendations based on user preferences, quiz responses, purchase history, and interactions.

Taste recommendations are subjective and are not guarantees that a particular customer will enjoy a particular product.

Recommendations are not medical or nutritional advice.

1.6 Purchases

Hightower-operated retail purchases are subject to the Retail Checkout Terms, Refund Policy, and Shipping Policy.

Placing an order authorizes the applicable purchase amount disclosed at checkout. An order confirmation acknowledges receipt and does not guarantee that the product can be obtained.

Where Hightower cannot fulfill an accepted order, Hightower will provide the legally required remedy.

1.7 Intellectual property

Hightower's original website content, software, design, original illustrations, branding, and other owned materials are protected by applicable intellectual-property laws.

Third-party brands, product names, logos, photographs, and descriptions remain subject to the rights of their respective owners.

A third-party product listing does not by itself indicate sponsorship, authorization, endorsement, affiliation, or partnership with Hightower.

1.8 User content

Where available, users may submit reviews, profile information, preferences, comments, product information, or other material.

Users retain their ownership rights and grant Hightower the limited license described in the Community Guidelines and applicable Seller Terms.

Users must have sufficient rights to submit any content they upload.

1.9 Platform rules

Users must not engage in fraud, harassment, intellectual-property infringement, unauthorized access, disruptive automation, impersonation, or other prohibited activities described in the Acceptable Use Policy.

Hightower may investigate suspected violations and take proportionate protective action.

1.10 Availability and changes

Features, listings, and services may change. We may modify, suspend, or discontinue features for legitimate operational, security, legal, or commercial reasons.

Changes do not eliminate rights arising from purchases already made.

1.11 Disclaimers

To the extent permitted by law, the platform's informational and discovery features are provided without guarantees of uninterrupted operation or error-free third-party information.

Nothing in these Terms excludes non-waivable consumer rights or any warranty or remedy that cannot lawfully be excluded.

1.12 Limitation of liability

To the fullest extent permitted by applicable law, Hightower will not be liable for indirect, incidental, consequential, or special damages arising from use of the platform where such exclusion is legally permissible.

1.13 Suspension and termination

Hightower may suspend or terminate accounts for material Terms violations, suspected fraud, security threats, unlawful conduct, or other legitimate reasons.

Where reasonable and legally required, users will receive notice and an opportunity to resolve the issue.

Termination does not extinguish existing payment, refund, privacy, or other surviving legal obligations.

1.14 Governing law and disputes

These Terms are governed by the laws of the State of Florida, without overriding mandatory consumer protections or otherwise applicable laws.

No mandatory arbitration agreement applies.
